Terms & Conditions of Letting

Please read in conjunction with the attached booking form.

1. General. Gwell Enys & Vesta Cottage is hired on the understanding that the accommodation is for holiday use only and that no right to remain in the accommodation exists for the Guest or anyone in the Guests' party.

2. Guests' Obligations. Care must be taken of Gwell Enys & Vesta Cottage and it must be left in a clean and tidy state with all furniture returned to where it was found upon entry. The Owners reserve the right to reasonably access the property during the period of hire.

3. Booking. Gwellenys & Vesta Cottage will not be considered to be reserved until we have issued a receipt for the necessary deposit.

4. Overseas Bookings. Eurocheques are acceptable but a cheque should not be made out for more than £700. The Owners reserve the right to charge a supplement to cover any loss due to currency fluctuations.

5. Insurance. Gwell Enys & Vesta Cottage is insured in respect of the usual risks covered by a building and contents policy. However, in certain circumstances it may not cover any loss or damage caused by negligence, in this instance guests would become liable. Guests are strongly advised to check the cover of the personal liability section of their own household policy and/or secure appropriate travel insurance. (Please be advised that damage which may result from burning candles within the cottage, is not covered by insurance).

6. Cancellation. In the event of you cancelling your holiday up to 8 weeks beforehand, you forfeit your booking deposit only, any cancellations within the 8 weeks prior to your holiday the balance paid is forfeited.

7. Non-Availability of Cottage. If, for any reason, the cottage becomes unavailable for the period of your booking, the Owners will refund the deposit in full and will be under no further liability towards the Guests.

8. Deposit. Bookings will only be accepted in writing on the Owners official form and, provided that the booking is made at least eight weeks before the holiday is due to start, are to be accompanied by a deposit of one-third of the rent. If a booking is made less than eight weeks before arrival, the full rent plus any additional charges, is due at the time of the booking. In the event of a booking not being accepted by the Owner all fees paid will be returned immediately.

9. Final Payment. Once the booking form is received and accepted by the Owners, the Guests are liable for payment within 24hrs of arrival at the property.

10. Price Changes. The Owners reserve the right to amend prices quoted due to errors and omissions, or changes in the VAT rate.

11. Method of Payment. Payments may be made by cheque, postal orders or cash. Cheques or postal orders should be made payable to Mrs J Griffiths and cash should always be sent by registered post. Unfortunately post-dated cheques are unacceptable.

12. Duration and Times of Letting. Unless otherwise stated, occupancy cannot be taken up until 1pm on the first day of the holiday and departure must be by 10am on the final day. When departures occur after 10am the guests may be charged for an additional day of rent.

13. Total Number in the Party. In no circumstances may the number of people stipulated in the property be exceeded and only those listed on the Booking Form may occupy the cottage.

14. Breakage/Damage. Guests must report to the Owners any damage or breakages that occur during their stay and an appropriate charge will be made for repair or replacement.

15. Linen. Linen is changed between holidays.

16. Descriptions. Some of the information in the details factor outside the property such as shops and public houses. Closure of such premises or other changes to external facilities are outside the Owner's control and therefore cannot be relied upon absolutely.

17. Complaints. All complaints must be reported to the Owners immediately so that an on-the-spot investigation can be made, if necessary, and remedial action taken, if required. In no circumstances will compensation be made for complaints raised after the holiday has ended, when the guests have denied the Owners the opportunity of investigating the complaint and endeavouring to put matters right during the holiday.

18. VAT. The Owners are not registered for VAT therefore no tax is payable.

19. Liability. The Owners do not accept liability for any act, neglect or default on the part of the Owners or any other persons not within their employ or otherwise under their control; nor for any accident, damage, loss, injury, expense or inconvenience, whether to person or property, which the Guests or any other person may suffer or incur arising out of, or in any way connected with, the letting.

20. Breach of Contract. If there is a breach of any of these conditions, the Owners reserve the right to re-enter the property and terminate the holiday without prejudice to the other rights and remedies of the Owners.

21. Authority to Sign. The person who signs the Booking Form certifies that he or she is authorised to agree to the Conditions for Hire on behalf of all persons included on the Booking Form, including those substituted or added at a later date. The signatory must be a member of the party intending to occupy the property and must be over the age of 18 years.
